Just have a consultation with a solicitor who specialises in issues around land disputes.
The law is very reasonable...if there's an issue requiring repair then I'm pretty confident there will be a way. Most people when presented with the facts will see the light...usually long before you need a court order!
But get your facts straight and know your rights under the law...then if needed you can roll them up and beat them over the head with it!
