Questions for OP (to assist)

1: What is your wall construction? 225 solid brick etc.
2: Does it have a damp proof course to your knowledge? Typically slate in that era. Or has it been treated in the past? With electro osmotic system or chemical DPC?
3: When was that pointing done and crucially is it like or cement?
4: What is the internal finish? Lime plaster? Or cement scud coat? Is there any insulation and if so what is it? Is there drying lining if so provide details.

Damp proof put in on that wall in 1985 by a company called triple treatment..they drilled the walls and filled them ..this has all been covered up now ..they treated the inside too. The walls are plaster .

I do not know the details of your case.

But it was very poorly handled as this would have been an easy one to resolve IMO. At the time. Not now.

I am a chartered professional who has specialised in such cases before and acted as professional witness in court for several such cases.

I have an architectural background. I would have the following minimum information to hand:

Certified Aerial Photos showing the history of the issue

Digital topo survey of the area including detailed cross sections of your home.

A report including input from an RICS surveyor and tanking specialists outlining the issue in great detail.

This would have been easy if approached correctly and with sufficient skill and knowledge. Sorry to say solicitor's aren't up to the task on their own.

This was a past life of mine I have a different role now and up to my neck so that's all ill say on the subject and hope pointing out correct approach and party wall act is of some assistance.

If legal routes failed you as you say and you don't want to go down that route again then hire the services of an architect and tanking specialist. You can address this at your home. Including doing an internal drained tanking system. Not ideal but if done correctly it will fix your damp issues for good

Do you mean the remedial solutions?

I am not good with costs as I specialise in Design.

You should engage the services of a local experienced Architectural Technologist who has experience in listed buildings.

They will carry out a measured survey and guide you on best solutions available. They will need to also seek the services of a specialist tanking company such as Grace Products or Fosroc. Their technical services will assist with designs too.

I have provided you with correct and accurate advice which I hope will help. Anything I say will be critically appraised by Gaz and others but I can assure you I know what I am talking about for what it is worth.

Good luck and I hope you get it sorted. I think forget lining solicitors pockets and do as above. Also ensure you serve neighbours notice and seek their agreement on any planned works in line with Party wall act. Don't be like them or leave them ammunition to take you up on it either.

That’s not exactly true, any question I’ve asked on this forum not welding related has been answered by people who know what they’re saying.

I‘m not a builder but I do have an old property and understand what causes damp issues.
In my opinion the best way to resolve the OP’s problem is to have a calm conversation with the neighbour, not go down the legal route. Any reasonable neighbour if the problem is explained would surely understand what the issue was and would accommodate a resolution.
A French drain was mentioned earlier, by digging out the soil, installing a drain and filling with gravel should reduce if not stop the problem, soil above the damp proof course is a problem.

I’m totally with @gaz1 regarding the whole damp proof injection con which is rife in the industry, I have a big story I could tell on that subject but I won’t as this is not my thread.

I would make trench along the wall had the thing to prevent the humidity to pass to the wall and then concrete

The answer is actually very simple, you have a legal right to enter your neighbours property to carry out maintenance on yours.

So use that right to repoint your wall and cure the damp by digging down and installing a reliable means of curing the damp.

Don't expect any financial help from them as they aren't to blame for the problem.

outside they would have followed the lay of the land in this case the slope of the land

therefore the inside is not fit for purpose

what you are stating is the exact same thing that you had done with your drive comment

that looks to be next doors drive not the ops driveway

Why wouldn’t a French drain make a difference?, I’ve had it work for me in the past on another old house I lived in. Surely gravel up against his wall as opposed to topsoil can only reduce the problem.

Too much talk about “legal” issues, just talk to the neighbour, the problem could be resolved for less than the cost of a couple of lawyers letters even if the OP has to pay for the resolution.
